O PROBLEMA DA FUNDAMENTAÇÃO DOS DIREITOS HUMANOS SEGUNDO HANNAH ARENDT
O cenário de uma democracia instável implica na formação de um contexto propício para o fracasso da efetivação dos direitos humanos, visto que o cumprimento destes está diretamente ligado à relação em que o sujeito mantém com o Estado. O projeto visa compreender de que maneira se dá esta relação entre direitos humanos e democracia e, especificamente, de que maneira estes se apresentam em um contexto de ruptura política. Não se trata de questionar a importância das declarações de direitos na emancipação e resistência ao arbítrio, mas sim de pensar criticamente a respeito de sua efetividade quanto à tutela jurídica da vida humana, caracterizando a crise e o limite desses conceitos.

Abstract:
The scene of an unstable democracy implies the formation of a context conducive to the failure of the realization of human rights, since the fulfillment of these is directly linked to the relationship in which the subject maintains with the State. The project aims to understand how this relationship between human rights and democracy takes place and, specifically, how they present themselves in a context of political rupture. It is not a question of questioning the importance of declarations of rights in emancipation and resistance to will, but to think critically about their effectiveness in terms of the legal protection of human life, characterizing the crisis and the limit of these concepts.
