Abstract: The Brazilian legal system is governed by fundamental principles in order to ensure justice and equity in legal proceedings, with the Principle of the Full Defense standing out, which is directly related to broad defense. These principles play a central role in all areas of criminal justice, particularly in the Jury Court. This research will address the importance of this provision in criminal procedural practice, focusing on the exposition of substantive law, more specifically the Penal Code, the Code of Criminal Procedure, and the Federal Constitution, in order to understand and exemplify the reality of the Brazilian legal system. To this end, a qualitative approach will be used, with a literature review, aiming to highlight the relevance of the topic in the context of the Jury Court. The topic is of great importance to the legal, social, and academic fields, as the Jury Court is a mechanism for exercising citizenship and demonstrates the importance of democracy in society. This article aims to analyze the impact of the principle of full defense in the Brazilian justice system, especially in the context of the Jury Court. It examines Brazilian legislation, supported by the ideas of prominent legal scholars and statistics on the reality of the jury court, highlighting the difficulties faced by lawyers in defending defendants and correlating the penalties applied in Brazil with the crimes committed. By exploring these aspects, the goal is to highlight how the guarantee of a broad and effective defense is essential for the application of justice in the Jury Court.
