O Poder Moderador na Primeira República do Brasil
O presente artigo tem como seu escopo principal constatar se, seja por herança prática da sua antiga existência, ou por necessidade política, o ente jurídico do poder moderador, na finalidade de trazer harmonia e estabilidade às instituições de Estado, extinto junto a monarquia, se fez presente, de alguma forma, nas discussões de elaboração da Constituição de 1891, ou por outro mecanismo que não o expressamente legal adotado durante o período. Para tal pretensão, após feito um breve estudo sobre a definição de poder moderador, passase para um enfoque maior aos eventos da primeira década da República, período em que se discutiu como o novo regime seria pensado e formatado na Constituição, e, principalmente, sua consolidação prática. Assim, por uma abordagem bibliográfica, serão estudadas as principais propostas e ideias discutidas a época e quais foram efetivamente levadas adiante e em quais circunstâncias.

Abstract:
The present article has as its main scope to verify if, either by practical inheritance of its former existence, or by political necessity, the legal entity of the moderating power, in order to bring harmony and stability to State institutions, extinct with the monarchy, if was present, in some way, in the discussions of elaboration of the Constitution of 1891, or by another mechanism than the expressly legal one adopted during the period. For this purpose, after a brief study on the definition of moderating power, we move on to a greater focus on the events of the first decade of the Republic, a period in which we discussed how the new regime would be thought and formatted in the Constitution, and, mainly, its practical consolidation. Thus, through a bibliographic approach, the main proposals and ideas discussed at the time will be studied and which were effectively carried forward and under what circumstances.
