O PLANO DE AÇÕES ARTICULADAS NO HORIZONTE DO FEDERALISMO BRASILEIRO: compreensões sobre a dinâmica de compartilhamento do poder

A compreensão da dinâmica de compartilhamento do poder nas

transformações recentes do federalismo brasileiro perpassa pela elucidação das

regras do jogo federativo existentes na interdependência entre os entes federados.

Este texto analisa as diretrizes relacionadas à concepção, elaboração e execução do

Plano de Ações Articuladas (PAR), discutindo seus limites e possibilidades mediante

o regime de colaboração. Tomando como referencial a literatura que versa sobre o

federalismo cooperativo, tendo como marco regulatório brasileiro a Constituição

Federal de 1988 e as concepções que regem o PAR, conclui-se que, apesar de

fortalecer a coordenação federativa do Ministério da Educação (MEC), o PAR traz

implicações negativas do ponto de vista do pacto federativo, pois se sustenta em

relações intergovernamentais cujo cerne está na dependência do ente local perante

o nacional, prevalecendo a autoridade hierárquica entre os entes.

Abstract:
The comprehension of the power-sharing dynamic in recent

transformations of Brazilian federalism requires an elucidation of the federative

game rules existent in the interdependency of the federated entities. This paper

analyzes the guidelines related to the conception, elaboration and execution of the

Plan of Articulated Actions (Plano de Ações Articuladas – PAR), discussing its limits

and possibilities through the collaboration regime. Taking as reference the theory of

cooperative federalism, having as a Brazilian regulatory framework the Federal

Constitution of 1988 and the conceptions that regulate the PAR, it is concluded that,

despite strengthening the federative coordination of the Ministry of Education

(Ministério da Educação – MEC), the PAR has negative implications from the point of

view of the federative pact as it is based on intergovernmental relations whose core

is in dependence of the local entity before the national, prevailing hierarchical

authority between the entities. Hence, the following recommendations aim to

improve the governments’ decision-making, with a particular focus on educational

management and collaboration.
