O PASSADO E O PRESENTE DE MÃOS DADAS: PERMANÊNCIAS DA DITADURA CIVIL MILITAR NA ATUAÇÃO REPRESSIVA DO ESTADO DEMOCRÁTICO DE DIREITO DO BRASIL
A presente pesquisa tem por objetivo demonstrar a permanência do crime de desaparecimento forçado de pessoas no Brasil, a partir do legado do período ditatorial até os dias atuais, utilizando-se, para tanto, a análise dos fatos envolvendo o desaparecimento de Rubens Paiva, na ditadura, e, de Amarildo Dias, no Estado Democrático de Direito, traçando um paralelo entre o período ditatorial e o presente. Dentro de uma perspectiva de violência institucional, a prática cotidiana de violação de direitos humanos persiste e é legitimada pelo Estado. Procura-se, destarte, ilustrar o crime de desaparecimento forçado, mesmo ausente a tipicidade penal em nosso ordenamento jurídico, apesar das determinações estabelecidas pelo direito internacional dos direitos humanos relativas à questão em análise. Nesse sentido, procura-se comprovar que, apesar da recomendação internacional, o Brasil ainda se adequa lentamente ao ramo do direito internacional público no tocante à matéria. Dessa maneira, a presente pesquisa, aponta as permanências da ditadura civil militar no Estado Democrático de Direito, a partir de uma abordagem qualitativa e análise de estudo de caso, concluindo que ainda estão presentes no nosso ordenamento jurídico os resquícios do regime ditatorial, nas instituições que compõem o sistema de justiça. O bônus pelas atrocidades cometidas pelos militares na ditadura foi a lei da anistia, o qual perdoou torturadores e torturados, logo não houve a efetivação da justiça de transição. A metodologia do presente trabalho, se pauta de fontes primárias, secundárias do método qualitativo e do estudo de caso.

Abstract:
The present research aims to demonstrate the permanence of the crime of forced disappearance of people in Brazil, from the legacy of the dictatorial period to the present day, using, for that, the analysis of the facts involving the disappearance of Rubens Paiva, in dictatorship, and, by Amarildo Dias, in the Democratic State of Law, drawing a parallel between the dictatorial period and the present. Within a perspective of institutional violence, the daily practice of human rights violation persists and is legitimized by the State. It seeks, therefore, to illustrate the crime of forced disappearance, even in the absence of criminality in our legal system, despite the determinations established by international human rights law regarding the issue under analysis. In this sense, it seeks to prove that, despite the international recommendation, Brazil is still slowly adapting to the field of public international law with regard to the matter. In this way, the present research points out the permanence of the military civil dictatorship in the Democratic State of Law, from a qualitative approach and case study analysis, concluding that the remnants of the dictatorial regime are still present in our legal system, in the institutions that make up the justice system. The bonus for the atrocities committed by the military during the dictatorship was the amnesty law, which pardoned torturers and tortured people, so there was no transitional justice. The methodology of the present work is guided by primary and secondary sources of the qualitative method and the case study.
