O PARADOXO DA INCLUSÃO: UM ENSAIO PÓS-ESTRUTURALISTA SOBRE DIREITOS SEXUAIS
No campo do direito, os Direitos
Sexuais, que de forma geral têm significado
todos os direitos concernentes às populações
LGBTI, têm sido focalizados a partir de uma
oposição estanque: ora são considerados
solucionadores dos problemas sociais que
envolvem essa população e, portanto,
‘emancipatórios’, ora são criticados como
normalizadores das relações LGBTI na
lógica intrinsecamente heteronormativa que
seria característica do Direito. No contexto
contemporâneo de ameaça aos Direitos
Sexuais, parece ser necessário buscar novas
abordagens acerca de suas potencialidades
e limitações. Esse trabalho, através de uma
perspectiva teórica e ensaísta, busca pensar
a formação e operação dos Direitos Sexuais
no viés do paradoxo, conforme proposto por
Joan Scott, escapando à enunciação daquela
oposição. Assim, através das proposições
pós-estruturalistas de Michel Foucault e Judith
Butler, aponta-se para a necessidade de mudar
a abordagem dos Direitos Sexuais, tanto no
contexto do campo jurídico, como em diálogo
com outras ciências sociais.

Abstract:
In the field of law, Sexual Rights,
which, in general, have been encompassing all
the rights pertaining to LGBTI populations, were
brought into focus by an impervious opposition:
at times they are considered to be solvers of
the social issues involving these populations,
therefore ‘emancipatory’, at other times they are
criticized as normalizers of LGBTI relations in an
intrinsically heteronormative logic that would be
characteristic of Law. Within the contemporary
context of threats to Sexual Rights, it seems
necessary to seek new approaches concerning
about their potentialities and limitations.
By applying a theoretical and essayistical
perspective, this article aims to reflect upon
the development and functioning of Sexual
Rights from the paradox slant as proposed by
Joan Scott, thus escaping the enunciation of
that opposition. In this sense, through the poststructuralist
propositions of Michel Foucault and
Judith Butler, it points to an urge for changing
how Sexual Rights are approached, both in the
context of legal sectors and dialogue with other social sciences.
