O NOME SOCIAL E SUA IMPORTÂNCIA NO ÂMBITO DO DIREITO PERSONALÍSSIMO
A pesquisa foi divulgada com base no parecer consultivo número 24, solicitado pelo Estado da Costa Rica em 2017. O Brasil respondeu a essa pergunta sobre a mudança do nome no Registro Civil e todos os outros documentos para garantir o bem-estar da população de transgênero, através do Nome Social. Tendo como objetivo demonstrar a importância do aconselhamento jurídico do quanto ao nome, que é um direito fundamental e personalíssimo. Este é usado para identificar o indivíduo como cidadão e transformá-lo em detentor de direitos. Usando a metodologia dedutiva pode-se concluir que o documento enfatiza a necessidade destes que querem mudar seus nomes para se adequarem à sua identidade de gênero, no caso da pesquisa em questão, portanto, isso pode proporcionar-lhes um bem-estar físico e psicológico contribuindo para a inclusão desta minoria: os transgêneros.

Abstract:
The survey was released on the basis of Advisory Opinion Nº 24 requested by the State of Costa Rica in 2017. Brazil responded to this question about the name change in the Civil Registry and all other documents to ensure the well-being of the population of transgender, through the Social Name. With the objective of demonstrating the importance of legal advice on the name, which is a fundamental right and very personal. This is used to identify the individual as a citizen and turn him into a rights holder. Using the deductive methodology one can conclude that the document emphasizes the need of these who want to change their names to suit their gender identity, in the case of the research in question, therefore, this can provide them with a physical and psychological well-being contributing to the inclusion of this minority: transgenders.
