"O NEOCONSTITUCIONALISMO, OS DIREITOS FUNDAMENTAIS E O DESENVOLVIMENTO SUSTENTÁVEL DAS CIDADES"
O presente estudo tem como finalidade analisar como a sustentabilidade pode ser utilizada como parâmetro de transformação das cidades, considerando a colisão de direitos fundamentais, de forma que se possa filtrar, constatar e discorrer acerca dos principais problemas quando se busca esse ideal sustentável. A pesquisa se justifica pela preocupação ao ideal de cidade sustentável, que encontra diversas dificuldades no mundo material, dentre elas as de caráter orçamentário, as escolhas políticas envolvidas, e, cerne do estudo, a colisão de direitos fundamentais, não se podendo cogitar que a transformação de um ambiente construído à sorte do acaso e da irregularidade durante séculos aconteça sem que se precise ponderar outros valores existentes naquele meio, mas com a certeza de que a pobreza e a desigualdade não podem continuar à indiferença do planejamento urbano. Desta maneira, o presente estudo tem como objetivo responder a seguinte problemática: os casos de colisão de direitos fundamentais na consecução de políticas públicas nas cidades, com vistas à construção de um local inclusivo, seguro, resiliente e sustentável, de forma a minimizar os impactos da pobreza, podem ser solucionados com base na própria sustentabilidade?

Abstract:
The present study aims to analyze how sustainability can be used as a parameter of transformation of cities, considering the collision of fundamental rights, so that one can filter, verify, and discuss the main problems when seeking this sustainable ideal. The research is justified by the concern to the ideal of a sustainable city, which encounters several difficulties in the material world, including the budgetary, political choices involved, and, at the heart of the study, the collision of fundamental rights, and it is not possible to consider that the transformation of an environment built to the sort of chance and irregularity for centuries happens without having to ponder other values existing in that environment, but with the certainty that poverty and inequality cannot continue to the indifference of urban planning. Thus, the present study aims to answer the following problem: can cases of collision of fundamental rights in the achievement of public policies in cities, with a view to building an inclusive, safe, resilient and sustainable place, in order to minimize the impacts of poverty, be solved on the basis of sustainability itself?
