O MODO DE SER E ESTAR NO COMPROMISSO COM O PROPÓSITO DA IGUALDADE
Segundo os aportes teóricos nos quais esta pesquisa foi desenvolvida, pode-se entender o princípio da igualdade como o pilar de sustentação de qualquer Estado Democrático de Direito. O sentimento de igualdade na sociedade moderna advoga pelo tratamento justo aos que ainda não conseguiram a viabilização e implementação de seus direitos básicos e fundamentais. Hodiernamente, é necessário reforçar tal concepção, de que “[...] igualdade não é dar a cada um, na razão do que vale, mas atribuir o mesmo a todos, como se todos se equivalessem”. Justifica-se, portanto, a compreensão do real objetivo da igualdade material e da igualdade formal, bem como a busca por uma sociedade com oportunidades para todos, justa e igualitária. Diante desta premissa, indaga-se: como conseguir reparar os malefícios que estão enraizados há séculos na sociedade, sem entender, ou ao menos se colocar no lugar dos excluídos por um instante sequer? Objetiva-se, com isso, estabelecer uma percepção no que tange à igualdade positivada na Constituição da República Federativa do Brasil de 1988 (CF/88). Nesse axioma encontra-se a análise dos direitos de segunda dimensão, que se apresentam como prestações positivas a serem implementadas pelo Estado Social de Direito, na busca por melhores e adequadas condições de vida. Os direitos sociais estão consagrados como fundamentos da República Federativa do Brasil, conforme dispõe o seu art. 6º.

Abstract:
According to the theoretical contributions in which this research was developed, the principle of equality can be understood as the mainstay of any Democratic State of Law. The feeling of equality in modern society advocates for the fair treatment of those who have not yet achieved the viability and implementation of their basic and fundamental rights. Today, it is necessary to reinforce this conception, that "[...] equality is not giving to everyone, for the reason that it is worth, but attributing the same to everyone, as if everyone is equivalent". Therefore, it is justified to understand the real objective of material equality and formal equality, as well as the search for a society with opportunities for all, fair and equal. In view of this premise, it is asked: how can we repair the evils that have been rooted in society for centuries, without understanding, or at least put ourselves in the place of the excluded for even an instant? The objective is, with this, to establish a perception regarding the equality positivized in the Constitution of the Federative Republic of Brazil of 1988 (CF / 88). Within this axiom is the analysis of second dimension rights, which present themselves as positive benefits to be implemented by the Social Rule of Law, in the search for better and adequate living conditions.
