O MEDIADOR NO JUDICIÁRIO: ELEIÇÃO OU CONCURSO UMA ANÁLISE A PARTIR DA OBRA DE PIERRE ROSANVALLON
O intuito do presente artigo é refletir sobre o papel do mediador e a forma de sua inclusão no cadastro de mediadores do(s) Tribunal(is) de Justiça dos Estados Brasileiros. Perquire-se a forma como é realizada a seleção dos mediadores para trabalhar na mediação judicial e sua adequação. Discorre-se sobre a importância do diálogo, da hermenêutica e da linguagem como forma de trabalhar o conflito e transformá-lo em algo positivo. O trabalho desenvolve-se a partir da análise teórica, apresentada por Pierre Rosanvallon, dos conceitos de eleição e concurso. Salienta que o processo de mudança instaurado e que apresenta novas formas de resolver os conflitos deve ser pensado como um processo sistêmico, devendo abordar a estrutura organizacional. A metodologia utilizada é a dialética.

Abstract:
The purpose of this article is to reflect on the role of the mediator and the form of its inclusion in the registry of mediators of the Court (s) of Justice of the Brazilian States. The way in which mediators are selected to work in judicial mediation and its adequacy is perceived. The importance of dialogue, hermeneutics and language is discussed as a way of working the conflict and transforming it into something positive. The work develops from the theoretical analysis, presented by Pierre Rosanvallon, of the concepts of election and contest. Stresses that the process of change initiated and that presents new ways of resolving conflicts must thought of as a systemic process, and should address the organizational structure. The methodology used is the dialectic.
