O MATRIMÔNIO NO FUERO REAL DE ALFONSO X, O SÁBIO
O matrimônio durante a Idade Média se apresentava como assunto de grande relevância, na medida em que era alvo de disputas por controle entre os poderes laico e clerical. A nobreza utilizava-se desta instituição para formar vínculos matrimoniais estratégicos, visando a segurança na transmissão da herança entre os familiares, bem como o engendramento de famílias poderosas. Noutra linha, a Igreja, buscava estabelecer um controle exclusivo sobre o casamento, tornando-o um sacramento, inserindo, desta forma, o relacionamento sexual dentro de normas rígidas, com redução do prazer e com finalidade de procriação, impondo, com isso, sua doutrina matrimonial que divergia dos intentos seculares. Neste capítulo abordaremos a fonte denominada Fuero Real, de autoria do monarca castelhano Alfonso X, (1252-1284), que trata especificamente no Livro III de temas relacionados à família, casamento, consentimento entre outros assuntos, revelando-se uma obra importante para análise da normatização do casamento no século XIII na Península Ibérica.

Abstract:
Marriage during the Middle Ages was a subject of great relevance, as it was the target of disputes for control between secular and clerical powers. The nobility used this institution to form strategic marriage bonds, aiming at security in the transmission of the inheritance among family members, as well as the engendering of powerful families. In another line, the Church sought to establish exclusive control over marriage, making it a sacrament, thus inserting sexual relationship within rigid norms, with reduction of pleasure and for the purpose of procreation, imposing with this, its matrimonial doctrine that diverged from secular intentions. In this chapter we will address the source called Fuero Real, authored by the Castilian monarch Alfonso X, (1252-1284), which deals specifically in the Book III of themes related to family, marriage, consent and other subjects, revealing an important work for the analysis of the regulation of marriage in the thirteenth century in the Iberian Peninsula.
