O LEGADO DA DIVERGÊNCIA DE GINSBURG NA INSTITUIÇÃO DO RECONHECIMENTO PELA EQUIDADE DE GÊNERO A PARTIR DO REVERSO
Este artigo decorre de pesquisa acadêmica que teve por objeto a análise da possível extensão a um gênero diverso de direitos sociais que, tem tese, representam proteção e garantia do gênero feminino, como mecanismo de efetivação da equidade. Para tanto, aplicou como metodologia de pesquisa o estudo de caso, a partir da análise de julgado perante a 1ª Vara da Fazenda Pública de Paranavaí-PR - Brasil, além das obras cinematográficas “Suprema” e RBG (A Juíza) que retrata parte da vida da Juíza da Suprema Corte dos Estados Unidos Ruth Bader Ginsburg, em cotejo com a Teoria do Reconhecimento, na forma proposta pelo sociólogo Axel Honneth, sobretudo quando considera a presença de um reconhecimento meramente ideológico. Ao fim, lança luzes sobre a importância da revisão normativa de garantias que tomam como ponto de partida exclusivamente o critério de gênero, posto ou construído, sob pena de produção de uma ofensa reversa ao direito.

Abstract:
This article is the result of academic research that aimed to analyze the possible extension to a diverse gender of social rights that, in theory, represent protection and guarantee of the female gender, as a mechanism for effecting equity. To this end, it applied the case study as a research methodology, based on the judgment of the judge before the 1st Court of the Public Finance of Paranavaí-PR - Brazil, in addition to the cinematographic works “Suprema” and RBG (The judge) that portrays part of the life of the United States Supreme Court Judge Ruth Bader Ginsburg, in comparison with the Theory of Recognition, in the form proposed by the sociologist Axel Honneth, especially when considering the existence of a merely ideological recognition. In the end, it sheds light on the importance of the normative revision of guarantees that take as a starting point exclusively the criterion of gender, set or built, under penalty of producing a reverse offense to the law.
