O JULGAMENTO DIRETO DO MÉRITO E O DUPLO GRAU DE JURISDIÇÃO: POSSIBILIDADE DE SUPERAÇÃO DO CONFLITO
O presente artigo trata da relação entre o julgamento direto do mérito (CPC, art. 1.013, §§ 3º e 4º) e o duplo grau de jurisdição. Analisa-se brevemente o conceito, os pressupostos e as hipóteses de incidência do julgamento direto do mérito pelos tribunais e discute-se a natureza constitucional do duplo grau de jurisdição, bem como a distinção entre direito a recurso e direito ao duplo exame de mérito. Também com enfoque em outros princípios constitucionais, como a duração razoável do processo e o devido processo legal, objetiva-se entender se há desrespeito ao duplo grau pela aplicação do instituto do julgamento direto do mérito e se é possível superar tal conflito.

Abstract:
This article deals with the relationship between the direct judgment of the merits (CPC, art. 1013, §§ 3 and 4) and the double degree of jurisdiction. The concept, assumptions and hypotheses of incidence of the direct judgment of the merits by the courts are briefly analyzed and the constitutional nature of the double degree of jurisdiction is discussed, as well as the distinction between the right to appeal and the right to double examination of the merits. Also focusing on other constitutional principles, such as the reasonable duration of the process and due process of law, the objective is to understand whether there is disrespect for the double degree by the application of the institute of direct judgment of the merits and if it is possible to overcome such conflict.
