O IMPACTO DAS FAKENEWS E O FOMENTO DOS DISCURSOS DE ÓDIO NA SOCIEDADE EM REDE: A CONTRIBUIÇÃO DA LIBERDADE DE EXPRESSÃO NA CONSOLIDAÇÃO DEMOCRÁTICA
O exercício imoderado do direito
constitucional à liberdade de expressão pode
levar ao abuso ilícito dessa prerrogativa, por
meio da disseminação das “fake news” e do
“hate speech” no contexto da sociedade em
rede, em razão do amplo acesso da população
às mídias digitais e às características peculiares
do ambiente cibernético. Ocorre que um direito
que tencionava resguardar a autonomia do
indivíduo e fortalecer a participação popular
na democracia pode, diante dos excessos,
contribuir para a indesejável exclusão daqueles
que são alvos das notícias falsas ou dos
discursos de ódio. Embora a regulação estatal
dos meios de comunicação seja uma alternativa
no combate à violação da dignidade da pessoa
humana em razão dos desdobramentos
abusivos da liberdade de expressão, há que
se ter cautela para que não seja (re)instalada
a censura. Emerge, então, a importãncia da
ponderação de interesses no caso concreto,
como instrumento mais adequado para indicar
qual direito deve prevalecer. Por meio dos
subprincípios da proporcionalidade, evita-se
o cerceamento desmedido da liberdade de
expressão, cuja limitação deve se dar, sempre,
a posteriori.

Abstract:
The immoderate exercise of the
constitutional right to freedom of expression
can lead to the illicit abuse of this prerogative
through the dissemination of fake news and
hate speech in the context of the network society
due to the broad access of the population to
digital media and the peculiar characteristics of
the cybernetic environment. It happens that a
right that intended to safeguard the autonomy
of the individual and to strengthen the popular
participation in the democracy can, before
the excesses, contribute to the undesirable
exclusion of those that are targets of the false
news or the discourses of hatred. Although the
state regulation of the media is an alternative in
the fight against the violation of the dignity of the
human person due to the abusive unfolding of
freedom of expression, care must be taken that
censorship is not (re) installed. The importance
of the balancing of interests in this case emerges
as a more appropriate instrument to indicate
which right should prevail. By means of the
sub-principles of proportionality, the excessive
restriction of freedom of expression is avoided,
and its limitation must always be a posteriori.
