O FOMENTO DA ATIVIDADE EMPRESÁRIA VISANDO O DESENVOLVIMENTO SOCIAL. UMA NOVA RELAÇÃO ESTADO-EMPRESA ATRAVÉS DA PARCERIA PÚBLICO-PRIVADA
Este artigo tratará da parceria público-privada que foi regulamentada no Brasil através da Lei nº. 11.079/2004, apresentando um novo modelo de relacionamento entre o Estado e a iniciativa privada, permitindo-lhes a aproximação legal e ética para montagem de projetos de infraestrutura para atendimento do interesse público e atingimento dos anseios da atividade empresarial. O contrabalanceamento dos interesses do parceiro público e do parceiro privado podem ser cotejados de forma antecipada, com a finalidade de viabilizar ou não a futura implantação de projeto de infraestrutura, sem que isso macule a licitude e o próprio interesse público. Será discorrido sobre o atual enfoque socioeconômico da empresa em contraposição à tradicional análise da sua função social. O estudo pretende analisar os efeitos que o fomento à atividade empresarial, através da parceria público-privada, pode ressoar no desenvolvimento social do país.

Abstract:
This article will deal with the public-private partnership that was regulated in Brazil through Law nº. 11.079 / 2004, presenting a new model of relationship between the State and the private sector, allowing them the legal and ethical approach to set up infrastructure projects to serve the public interest and achieve the desires of business activity. The counterbalancing of the interests of the public partner and the private partner can be compared in advance, with the purpose of enabling or not the future implementation of an infrastructure project, without this tarnishing the lawfulness and the public interest itself. It will be discussed about the current socio-economic approach of the company as opposed to the traditional analysis of its social function. The study intends to analyze the effects that the promotion of entrepreneurial activity, through the public-private partnership, can resonate in the social development of the country.
