O ESTADO E OS BENEFÍCIOS SOCIAIS
A Constituição Federal de 1988 trouxe como direitos fundamentais a previdência social, a saúde e a assistência social, que compõe a seguridade social, universal, uniforme e equivalente em benefícios sociais, seletividade e distributividade, irredutibilidade do valor dos benefícios e equidade na forma de participação no custeio, financiada por toda a sociedade, direta e indiretamente, e pelos entes federados, possibilitando-se ao Estado proteger as pessoas, geral e sem restrição, ou somente as mais necessitadas, ora com contribuição de forma distributiva e solidária, com critérios que preservem o equilíbrio financeiro e atuarial, na forma de seguro, ora de forma contributiva e solidária.

Abstract:
The Federal Constitution of 1988 introduced as fundamental rights social security, health and social assistance, which makes up social security, universal, uniform and equivalent in social benefits, selectivity and distributivity, irreducibility of the value of the benefits and equity in the form of participation in the costing, financed by the whole society, directly and indirectly, and by the federated entities, enabling the State to protect people, general and without restriction, or only the most needy, sometimes with a distributive and solidary contribution, with criteria that preserve the financial and actuarial balance, in the form of insurance, sometimes in a contributive and supportive way.
