O ESTADO DE EXCEÇAO NA VISAO DE GIORGIO AGAMBEN E HANNAH ARENDT: UMA ANÁLISE JURÍDICA A PARTIR DA REALIDADE BRASILEIRA
A diferença entre a Zoé e a Bío, é que a zoé é a vida nua e sem nenhuma interferência política e a partir do momento que a zoé é incluída na bío, tem-se a transformação em biopolítica. Com isso, o ser humano passa a ser inserido na vida política e por tanto, começa a ter uma vida matável e insacrificável, uma inclusão exclusiva, uma verdadeira matabilidade. Dessa forma, o homem passa a ser sujeito do poder político e o que entra em questão é a vida nua do cidadão, onde entra também a democracia moderna querendo encontrar o bíos da zoé, ou seja, os seus direitos, liberdade e a não submissão. Fica explícita a existência de uma biopolítica totalitária por conta da vida nua sob forma de exceção e incluída através de uma exceção.

Abstract:
The difference between Zoé and Bío, is that the zoé is the naked life and without any political interference and from the moment that the zoé is included in the bio, there is the transformation into biopolitics. With that, the human being starts to be inserted in the political life and for that reason, begins to have a life that is maturable and insatrifiable, an exclusive inclusion, a true matability. In this way, man becomes the subject of political power and what comes into question is the naked life of the citizen, where modern democracy also wants to find the zoos' bios, that is, his rights, freedom and non-submission. It is explicit the existence of a totalitarian biopolitics on account of naked life in the form of an exception and included through an exception.
