O ESTADO ATUAL DA GESTAÇÃO POR SUBSTITUIÇÃO À LUZ DO ORDENAMENTO JURÍDICO BRASILEIRO
O presente estudo aborda a complexidade do tema “gestação por substituição”, trazendo em seu contexto a possibilidade do uso dessa técnica científica à luz do ordenamento jurídico brasileiro que carece de legislação específica para regulamentar o assunto. Em primeiro momento sintetiza a respeito do conceito de família no direito brasileiro, evidenciando a liberdade de formação familiar. O segundo capítulo se resume a demonstrar, de forma breve, as repercussões do desenvolvimento da medicina e da biotecnologia e situá-las no lugar-comum da bioética e do biodireito. Através de pesquisa bibliográfica, resolução n° 2.168/17 do Conselho Federal de Medicina (CFM) e projeto de lei, este trabalho tem por objetivo elucidar a real necessidade de uma regulamentação normativa, vez que o direito precisa acompanhar a evolução da sociedade frente às suas necessidades contemporâneas, trazendo o Biodireito como parte da ciência jurídica que observa o humano perante à lei. Apesar da lacuna legislativa, atualmente, a reprodução assistida é uma das opções procuradas para aqueles que desejam procriar e por algum entrave clínico não conseguem. Há quem se posicione a favor e contra o método da gestação por substituição, contudo, independente das divergências, é inegável que a falta de uma lei específica possa gerar problemas éticos, religiosos, financeiros e emocionais.

Abstract:
The following study talks about the complexity of “gestation by substitution”, that brings in this context the possibility of using this scientific technique for the Brazilian legal orders that misses the rules for this situation. Firstly, synthetizes the concept of family in Brazilians law, pointing free formation of families. The second chapter summarizes itself in demonstrate the repercussion of medicine and biotechnology developing and situate them in bioethics and bio-laws. By a bibliography research, resolution number 2.168/17 of Conselho Federal de Medicina (CFM) and law project, this work has the objective to clarify the real necessity of one normative regulation, once the laws needs to keep up with the evolution of humanity front of their contemporary necessities, bringing the bio-laws like a sort part of legal science that observes the human towards the law. Even though the legislative chasm, currently, the assisted reproduction is one of the most wanted options for the ones who wants to procreate and because a clinic problem couldn’t do it. The are people who agree with the method of gestation by substitution, although, it’s undeniable that the missing of specific laws can generate ethics, religious, financial and emotional problems.
