O ENSINO RELIGIOSO NAS ESTRATÉGIAS POLÍTICAS CONTEMPORÂNEAS DE DESMONTE DA CONSTITUIÇÃO BRASILEIRA: UMA INVOLUÇÃO DO PROCESSO
O presente trabalho aborda a relação Igreja e Estado no Brasil e analisa a situação atual do Ensino Religioso sob a luz de um Tratado Internacional firmado entre o Brasil e a Santa Sé, que fora aprovado pelo Congresso Nacional em 7 de outubro de 2009, e assegurou a mudança da interpretação da Carta Magna, recuperando o caráter “religioso” ao ensino da matéria cuja confessionalidade havia sido proibida. A análise do documento supraconstitucional mostra como, estrategicamente, substituiu-se a concepção Ensino Religioso, obrigando assim, um novo entendimento da questão circunscrita no âmbito da própria Constituição Federal. Tal investida fere substancialmente o conceito de laicidade conquistado por longa batalha travada por setores progressistas da sociedade desde a Proclamação da República, e mostra os caminhos pelos quais se está produzindo a desconstituição do Estado Democrático de Direito, expresso pela Constituição Cidadã de 1988.

Abstract:
This study correlates the Church and Political State, analyzing the current situation of Religious Education in Brazil. The International agreement signed between Brazil and the Holy See, which was approved by the National Congress on October 7, 2009, caused a change in the interpretation of the Magna Carta, recovering the “religious” character of education, whose confessionality had been prohibited. The analysis of the supra constitutional document demonstrates the strategies used to replace the concepts of Religious Education, thus forcing a new interpretation and understanding of the circumscribed issue within the Federal Constitution itself. This invasive action attacks the concept of laic State, conquered after a long debate accomplished by the progressive sectors of society since the proclamation of the Republic, and exemplifies the deconstruction of the Democratic State of Law, guaranteed in the Citizen Constitution of 1988.
