O DIREITO VIVO DE EUGEN EHRLICH E AS SUAS MANIFESTAÇÕES NO ORDENAMENTO JURÍDICO BRASILEIRO
O presente artigo tem por objetivo analisar o instituto do Direito Vivo sob a ótica de Eugen Ehrlich e algumas de suas manifestações no ordenamento jurídico brasileiro. Sabe-se que Ehrlich, adepto da corrente do direito livre, desenvolveu um método de compreender o fenômeno jurídico a partir da análise sociológica dos fatos sociais, dando ênfase ao aspecto fático-normativo do direito, e não apenas, na concepção de que o direito se encontra na legislação. Ao refutar tal entendimento, Eugen sustenta que o Direito Vivo se desenvolve nas associações como a família, o Estado e a comunidade, sendo característica a sua dinamicidade. Revela a necessidade de o jurista transformar esses fatos normativos em preceitos jurídicos, denominado direito legislado.

Abstract:
This article aims to analyze the Instituto do Direito Vivo from the perspective of Eugen Ehrlich and some of its manifestations in the Brazilian legal system. It is known that Ehrlich, a supporter of the free law chain, developed a method of understanding the legal phenomenon from the sociological analysis of social facts, emphasizing the factual-normative aspect of law, and not only, in the conception that law is in the legislation. In refuting this understanding, Eugen maintains that the Living Law develops in associations such as the family, the State and the community, its dynamism being characteristic. It reveals the need for the jurist to transform these normative facts into legal precepts, known as legislated law.
