O DIREITO REGISTRAL: ESTRUTURA DO REGISTRO DE IMÓVEL EM PROL DO MEIO AMBIENTE
O presente artigo tem como
objetivo analisar a estrutura do Registro de
Imóveis, visando benefícios ao Meio Ambiente,
bem como a sua publicização. Analisaremos
também, como são constituídos os espaços
territoriais especialmente protegidos (ETEPs).
Observa-se que o Registro de Imóveis surgiu
como mecanismo para controle do Direito de
Propriedade e como instrumento de segurança
jurídica para o tráfego imobiliário. Por sua vez,
em virtude da constante evolução do Direito
Ambiental e consequente transformação do
Direito de Propriedade, que passou a atender
uma função social, faz-se necessário o
estudo das novas características do Registro
de Imóveis, mormente, a premência de sua
aplicação às normas de proteção ambiental e
utilização de sua estrutura para tal finalidade.
Serão demonstrados aspectos referentes à
Propriedade Imobiliária, ao Meio Ambiente e
à publicidade registral, no intuito de averiguar
a segurança jurídica no tráfego imobiliário e
o papel do registrador no fornecimento de
informações sobre imóveis em atendimento à
função social da propriedade e preservação
do meio ambiente. Analisaremos a presença
do Registro de Imóveis na tutela de espaços
territoriais especialmente protegidos, bem
como serão demonstrados mecanismos que
visam garantir o cumprimento de sanções e
obrigações ambientais.

Abstract:
This article aims to analyze the
structure of the Real Estate Registry, aiming at
environmental benefits, as well as its publication.
We will also analyze how specially protected
territorial spaces (ETEPs) are constituted. It is
noted that the Real Estate Registry emerged
as a mechanism for controlling property law
and as a legal security instrument for real
estate traffic. Due to the constant evolution of
the Environmental Law and the consequent
transformation of the Property Law, which
now serves a social function, it is necessary to
study the new characteristics of the Real Estate
Registry. Especially the urgency of its application
to environmental protection standards and use
of its structure for such purpose. Aspects related
to real estate, the environment and publicity, will be demonstrated in order to determine
legal certainty in real estate traffic and the role of the registrar in providing information
on real estate in compliance with the social function of property and environmental
preservation. We will analyze the presence of the Real Estate Registry in the protection
of specially protected territorial spaces, as well as mechanisms to ensure compliance
with environmental sanctions and obligations.
