O DIREITO PENAL COMO “ARMA” NO CONTROLE SOCIAL
Neste artigo, cujo tema discute o Direito Penal como arma no controle social, busca-se fazer uma reflexão sobre a efetiva finalidade desta importante “ferramenta” jurídica para a harmonização do viver social. Para tanto, diante de uma busca exploratória bibliográfica, são resgatados ensinamentos de diversos autores, os quais esclarecem alguns pontos no sentido de afirmar que este campo do Direito pode se tornar uma arma na mão do poder, ou de quem nele está, onde tendo-se por fim a garantia do subjugo daqueles que eventualmente contrariem os interesses ou abalem a pretensão de permanência do Soberano e seu staff, dito “poder” criminaliza ou descriminaliza condutas em razão das suas ideologias e interesses pessoais.

Abstract:
In this article, whose theme discusses Criminal Law as a weapon in social control, we seek to reflect on the effective purpose of this important legal "tool" for the harmonization of social living. Therefore, in the face of an exploratory bibliographic search, teachings of several authors are rescued, which clarify some points in the affirmation that this field of Law can become a weapon in the hand of the power, or of who is in it, having finally the guarantee of the subjugation of those who eventually contradict the interests or undermine the claim of permanence of the Sovereign and his staff, this "power" criminalizes or decriminalizes conduct due to their ideologies and personal interests.
