O DIREITO À EDUCAÇÃO NO BRASIL: teorizações e reflexões
A ideia deste estudo teórico não é esgotar as questões relacionadas ao direito à educação, mas construir um aparato teórico mínimo que possibilite a compreensão desse direito social, relacionado à concepção de justiça social, realizando uma reflexão introdutória, porém fundamental. A reflexão se inicia discutindo a fundação do Estado Nacional, o qual possibilitou a saída de uma sociedade natural para outra, pautada em uma concepção de justiça social, levando à organização de uma sociedade de bem-estar social, fundamentada em direitos socialmente constituídos. Em um segundo momento discute a crise dessa sociedade, a partir da complexificação do capital e da mundialização da economia. Em um terceiro momento, contextualiza a realidade brasileira e o surgimento do Estado Social em nosso país. E, por fim, reflete acerca dos direitos sociais e, nesse rol, do direito à educação.

Abstract:
The idea of this theoretical study is not to exhaust the questions related to the right to education, but to construct a minimal theoretical apparatus that allows the understanding of this social right, related to the conception of social justice, realizing an introductory reflection, but fundamental. The reflection begins by discussing the founding of the National State, which allowed the departure of a natural society to another, based on a conception of social justice, leading to the organization of a social welfare state, based on socially constituted rights. In a second moment it discusses the crisis of this society, from the complexification of capital and the globalization of the economy. In a third moment, it contextualizes the Brazilian reality and the emergence of the Social State in our country. And, finally, it reflects on social rights and, in that role, the right to education.
