O DIREITO À EDUCAÇÃO EM AMBIENTE CARCERÁRIO: uma análise sob a ótica da Lei de Execução Penal (Lei 7.214/84) e da nota técnica nº14/2020/COECE/CGCAP/DIRPP/DEPEN/MJ
O Direito à educação trata-se de uma garantia Constitucional de segunda geração e ao lado dos direitos que nascem de políticas públicas assistencialistas, saúde, habitação, educação, lazer, dentre outros, ocupa um lugar de destaque no Estado Democrático de Direito. O objetivo principal deste trabalho consiste em discorrer sobre o direito a educação em ambiente carcerário sob a ótica da LEP (Lei de Execução Penal – Lei 7.210/84). Os objetivos secundários concentram-se em analisar o conceito de pena sob a perspectiva da obra “Dos delitos e da Penas” de Cesare Beccaria e analisar a Nota Técnica n.º 14/2020/COECE/CGCAP/DIRPP/DEPEN/MJ que versa sobre a evolução dos índices de encarcerados envolvidos em atividades educacionais. A metodologia consiste em uma pesquisa bibliográfica de caráter qualitativo, pautada na doutrina BECCARIA (1764), AVENA (2017), NUCCI (2018) e FOUCAULT (1987). A efetividade da prestação ao direito à educação em ambiente carcerário revela-se um desafio de grande proporção a ser superado pelo Estado, enquanto responsável pela manutenção da ordem e do bem estar social, tendo em vista que os dados do Departamento Penitenciário Nacional sobre os índices de pessoas encarceradas em atividade educacional são tímidos, revelando que a proporção em 2012 era de 8,64% e em 2019 de 16,56%.

Abstract:
The right to education is a second-generation Constitutional guarantee and alongside the rights that arise from welfare public policies, health, housing, education, leisure, among others, occupies a prominent place in the Democratic Rule of Law. The main objective of this work is to discuss the right to education in a prison environment from the perspective of the LEP (Law of Penal Execution - Law 7,210/84). The secondary objectives are to analyze the concept of penalty from the perspective of the work “Dos delitos e da Penas” by Cesare Beccaria and to analyze Technical Note No. 14/2020 / COECE / CGCAP / DIRPP / DEPEN / MJ on the evolution of the incarcerated rates involved in educational activities. The methodology consists of a qualitative bibliographic research, based on the doctrine BECCARIA (1764), AVENA (2017), NUCCI (2018) and FOUCAULT (1999). The effectiveness of the provision of the right to education in a prison environment proves to be a major challenge to be overcome by the State, as responsible for maintaining order and social welfare, considering that the data from the National Penitentiary Department on the indexes of people incarcerated in educational activity are shy, revealing that the proportion in 2012 was 8.64% and in 2019 16.56%.
