Abstract:
The research on the State's neglect with the abandonment of children and adolescents and the stigmatization of society with same-sex couples aimed to bring changes in each historical context experienced by society to the present day, how adoption came to be seen and how it materialized in Law. The different ways in which it was seen by each society and, mainly, how it is recognized today in Brazil. In addition to demonstrating projects that are aimed at helping children in the adoption system, projects that try to facilitate and encourage legal adoption. Face-to-face and virtual surveys were carried out on account of the Covid-19 pandemic to obtain answers to certain questions. Throughout the article, it will be possible to notice that same-sex couples are still minorities, but already occupy a space in the interest in adopting. However, the participation of the State in each historical period up to the present day will be analyzed, in addition to exposing the contractualist way that the State saw abandoned children and adolescents, these were considered the means to the ends of families who were unable to have biological children, the State did not care about the conditions of the families, it only cared about “getting rid of the problems” as quickly as possible, that is, the State, superior authority, became a negligent authority with the future of the nation itself. With the consent of the people or lack thereof, the State arbitrated in the way that suited it, until today the rulers continue to fight for this form of government to be perpetual, but the Brazilian people realized that they have the right to speak and the right to be heard, because the State machine needs the help of the inhabitants to be able to turn, and the workers of this great machine are tired of injustices and inequalities, since everyone is worthy of everything that the Constitution of 1988 guarantees.
