O CONSTITUCIONALISMO DO FUTURO: UMA ANÁLISE CRÍTICA ACERCA DA VIABILIDADE DAS PREMISSAS DO CONSTITUCIONALISMO DE JOSÉ ROBERTO DROMI NO BRASIL
O presente artigo aborda a proposta doutrinária do jurista argentino José Roberto Dromi que defende um constitucionalismo do futuro como sucessor do neoconstitucionalismo, onde traz sete premissas como valores. Para tal desiderato, utilizou-se de uma abordagem qualitativa, através de procedimentos metodológicos histórico, comparativo e dedutivo. Nesse sentido, em primeiro plano, o estudo irá abordar uma evolução do movimento constitucionalista e sua relevância no contexto neoconstitucional e uma possível influência no constitucionalismo vindouro. Ademais, serão revistos os fundamentos básicos deste fenômeno desenvolvido pelo autor. Isto posto, será feita uma análise para entender se as premissas do constitucionalismo do porvir são, de fato, do futuro; se o constitucionalismo do futuro, com base no estudo de Dromi, será viável no cenário brasileiro ou, se já estão institucionalizadas na legislação brasileira vigente – porém, desprovidas de efetivação. Por fim, tomando uma posição, será dado juízo valorativo sobre o assunto.

Abstract:
This present paper approaches the doctrinaire proposal of the argentine jurist José Roberto Dromi, that defends a Constitucionalism from the Future as the successor of neoconstitucionalism, where it brings out seven premises as values. In this sense, it was used a qualitative approach, through methodologic proceedings such as the historical, comparative and deductive. /in this sense, in foreground, the study will address an evolution of the constitutionalist movement and its relevance in the neoconstitutional context and a possible influence on the coming constitutionalism. In addition, will be reviewed the basic foundations of this phenomenon developed by the author. After this, will be held an analysis to understand if the premises of the constitutionalism from the future are, in fact, from the future; if the constitutionalism from the future, based on Dromi’s studies, is viable in the Brazilian scenario or if they are already institutionalized in Brazilian’s law in force - but deprived of effectiveness. Finally, by taking a position, value judgment will be given on the subject.
