O CASO DANIELLA PEREZ E A LEI DE CRIMES HEDIONDOS: UMA ANÁLISE BIBLIOGRÁFICA ATUAL
Após a morte da atriz Daniella Ferrante Perez Gazolla, nos anos 90, assassinada por seu colega de cena Guilherme de Pádua Thomaz e sua esposa Paula Nogueira Tomaz, com golpes de objeto pontiagudo, com aproximadamente 18 perfurações em um ambiente de matagal, o crime teve percussão nacional e internacional levando em voga a comoção popular em busca de justiça efetiva. Eventualmente, dada magnitude ao qual tiveram os fatos tal impacto midiático questionou a necessidade de classificação de homicídio qualificado como crime hediondo, sendo que os entornos do caso ainda estão discussão pela sociedade. A partir dessa perspectiva, teve-se como intuito realizar uma pesquisa qualitativa e bibliográfica, na qual se leva em consideração a qualidade e não quantidade dos dados obtidos, tendo como fonte de dados pesquisas realizadas anteriormente, dentre elas, artigos, trabalhos de conclusão de curso, teses e dissertações. Para tanto, foi definido o objetivo de analisar as questões em torno da Lei 8.071, com foco no que tange a influência dos aspectos ligados ao caso Daniella Perez, tanto do ponto de vista jurídico, quanto do ponto de vista social, tendo como base a disseminação da mídia. Uma vez que após 30 anos, o crime ainda está em voga na sociedade, em 2022 o mesmo voltou a mídia com o documentário “Pacto de Sangue” exibido pela HBO ao qual, como o título sugere, são realizados apontamentos que descrevem que o assassinato de Daniella Perez teve caráter lúgubre devido a brutalidade. Assim, esse artigo apresenta um ponto de vista acerca do caso da perspectiva social para os reflexos jurídicos, subdividivo em “O caso Daniella Perez”, detalhado os fatos em torno do caso, com base na investigações e perícia; “Impacto Midiático”, descrito o quão disseminado o caso foi discutido e apontados os impactos em torno dessa repercussão. “Homicídio qualificado caracterizado como crime hediondo”, detalhado o reflexo do Caso Daniella Perez em torno das alterações na lei de crimes hediondos.

Abstract:
After the death of actress Daniella Ferrante Perez Gazolla, in the 1990s, murdered by her co-star Guilherme de Pádua Thomaz and his wife Paula Nogueira Tomaz, with a sharp object, with approximately 18 perforations in a thicket environment, this crime had national and international percussion, bringing popular commotion in search of effective justice. Eventually, given the magnitude to which the facts had such media impact, it questioned the need to classify qualified homicide as a heinous crime, and the surroundings of the case are still in society. From this perspective, the aim was to carry out a qualitative and bibliographic research, in which the quality and not the quantity of the data obtained are taken into account, having as a source of data research carried out previously, among them, articles, final works of course, theses and dissertations. To this end, the objective of analyzing the issues surrounding Law 8071 was defined, focusing on the influence of aspects related to the Daniella Perez case, both from a legal point of view and from a social point of view, based on the media dissemination. Since after 30 years, crime is still in society, in 2022 it returned to the media with the documentary “Pacto de Sangue” aired by HBO in which, as the title suggests, notes are made that describe that the murder by Daniella Perez had a dismal character due to brutality. Thus, this article presents a point of view about the case of the social perspective for the legal reflexes, subdivided into “The Daniella Perez case”, detailing the facts surrounding the case, based on investigations and expertise; “Media Impact”, describing how widespread the case was discussed and pointing out the impacts around this repercussion. “Qualified homicide characterized as a heinous crime”, detailed the reflection of the Daniella Perez Case around the changes in the heinous crimes law.
