O BUSÍLIS FILOSÓFICO DA PENA DE MORTE COMO DIREITO FUNDAMENTAL FACE À CONSTITUIÇÃO FEDERAL BRASILEIRA
The reflections developed here are about the possibility of establishing the death penalty in Brazil through the Constituent Power. The objective of this work is supported by a philosophical analysis of the fundamental human rights, as well as the position which must be taken by the State in relation to citizens. Thus one can analyze the true and transcendent qualities of the rights guaranteed in the constitutional framework, and the reason why Brazilian law acts in a protective manner towards these fundamental rights and guarantees preventing them from being altered by the Constitutional Reform Power.

Abstract:
Como se poderá depreender da leitura do trabalho a seguir exposto, as reflexões aqui desenvolvidas versam sobre a existência da possibilidade de instituir-se a pena de morte no Brasil por intermédio do Poder Constituinte Originário. O objetivo do mencionado trabalho estriba-se em uma análise filosófica a respeito dos direitos fundamentais atribuídos ao homem, assim como a posição a qual deve ser tomada pelo Estado em face aos cidadãos, de maneira com que se analise as verdadeiras e transcendentes quididades dos direitos proclamados e assegurados no bojo constitucional, e a razão pela qual o Direito brasileiro age de maneira protetiva para com estes direitos e garantias fundamentais impedindo sua alteração por meio do Poder Constituinte Derivado Reformador.
