O APERFEIÇOAMENTO DA JUSTIÇA ADMINISTRATIVA FORA DO PODER JUDICIÁRIO
O presente trabalho propõe verificar os principais pontos críticos que culminam na sobrecarga do Poder Judiciário em demandas que envolvem a Administração Pública. O objetivo é demonstrar que a atuação indiscriminada do Poder Judiciário não raras vezes gera verdadeira injustiça, visto que os magistrados, em regra, não detêm o conhecimento específico necessário para atuar em demandas em que uma das partes é o próprio poder público. Não se trata de menosprezar o importante princípio da inafastabilidade da jurisdição, mas demonstrar que levar toda e qualquer contenda ao Judiciário, por si só, não significa atingir a justiça social tão almejada e a efetiva proteção dos direitos fundamentais do cidadão. O que se deseja evidenciar com este trabalho é que a própria Administração Pública detém o conhecimento específico para atuar nestas demandas, visto conhecer a fundo os meandros do ordenamento jurídico do ente público.

Abstract:
The present work proposes to verify the main critical points that culminate in the overload of the Judiciary Power in demands that involve the Public Administration. The objective is to demonstrate that the indiscriminate action of the Judiciary Power often generates real injustice, since magistrates do not have the specific knowledge necessary to act in demands in which one of the parties is the public power itself. It is not a matter of underestimating the important principle of the inescapability of jurisdiction, but demonstrating that bringing any dispute to the Judiciary, by itself, does not mean achieving the so desired social justice and the effective protection of the fundamental rights of citizens. What we want to show with this work is that the Public Administration itself has the specific knowledge to act on these demands, since it knows in depth the ins and outs of the legal system of the public entity.
