O ACESSO À JUSTIÇA NO SISTEMA INTERAMERICANO DE PROTEÇÃO DOS DIREITOS HUMANOS
O acesso à justiça foi reconhecido e desenvolvido pela doutrina como direito fundamental, apesar de não existir um reconhecimento expresso como tal. A Convenção Americana de Direitos Humanos tem sido a principal fonte normativa, e a jurisprudência da Corte Interamericana de Direitos Humanos que a reconheceu como um direito fundamental, o qual que se encontra nos artigos 8 e 25, com relação ao artigo 1.1 da Convenção, ao mesmo tempo que foi atribuindo conteúdos, desenvolvendo-se não somente na área penal, bem como aplicável em todas as áreas, considerando-se dessa forma, como o Direito dos direitos.

Abstract:
Access to justice has been recognized and developed by the doctrine as a fundamental right, although there is no express recognition as such. The American Convention on Human Rights has been the main normative source, and the jurisprudence of the Inter-American Court of Human Rights is the one that has recognized it as a fundamental right, placing it in Articles 8 and 25, in relation to Article 1.1 of the Convention, and at the same time it has been providing content, developing beyond the criminal area, but applicable to all areas, considered as the right of rights.
