O ABORTO LEGAL E SUA (DES)VINCULAÇÃO A MORAL E A RELIGIÃO NO BRASIL
o presente artigo aborda a questão do aborto legal frente à possibilidade da sua desvinculação moral e religiosa, com base em uma análise da Constituição Federal de 1988. Atentando-se para a possibilidade de pautar o aborto como norma de saúde pública, como instrumento de efetivação de um Estado laico. Ainda, considerando a tendenciosidade religiosa expressa no legislativo, com base no método hipotético dedutivo, foi realizada uma reflexão sobre como a religião tem impedido o avanço da legislação sobre o aborto, bem como, o papel exercido pelo judiciário, frente à omissão legislativa. Por fim, o estudo objetivou uma análise das hipóteses de aborto legal no Brasil, verificando precedentes em torno do tema bem como o impacto da laicidade no contexto das decisões emitidas pelo judiciário e sua influência em torno do avanço de paradigmas para as liberdades individuais.

Abstract:
This article addresses the issue of legal abortion in view of the possibility of its moral and religious disengagement, based on an analysis of the 1988 Federal Constitution. of a secular state. Still, considering the religious bias expressed in the legislature, based on the hypothetical deductive method, a reflection was carried out on how religion has impeded the advancement of legislation on abortion, as well as the role played by the judiciary, in the face of legislative omission. Finally, the study aimed to analyze the hypotheses of legal abortion in Brazil, verifying precedents around the topic as well as the impact of secularism in the context of decisions issued by the judiciary and its influence on the advancement of paradigms for individual freedoms.
