O ABANDONO INFANTOJUVENIL, OS DIREITOS HUMANOS E O ESTATUTO DA CRIANÇA E DO ADOLESCENTE
O presente estudo, integrante do projeto DIREITOS HUMANOS EM CAMPO GRANDE E A INTERSUBJETIVIDADE EM TERMOS DA ÉTICA E DA ALTERIDADE: UM ESTUDO JURÍDICO-FILOSÓFICO E EDUCACIONAL (DHIEA), apresenta os resultados de uma pesquisa que analisou a problemática do abandono infanto-juvenil sob uma perspectiva legal-humanista, por meio dos direitos humanos e o Estatuto da Criança e do Adolescente. Neste contexto, busca-se, primeiramente, definir o conceito de abandono analisado por este projeto científico, para então compreender o posicionamento do ordenamento jurídico brasileiro frente a esse cenário contemporâneo problemático, no qual o abandono infanto-juvenil merece ainda mais atenção da sociedade e do Estado. Foram empregados como recursos a revisão bibliográfica, o método de abordagem hipotético-dedutivo e a observação assistemática, com enfoque em uma análise horizontal e interdisciplinar. Os resultados evidenciaram que o Direito nacional se porta de forma robusta, por meio de um aparato jurídico-estatal bem estabelecido, que apresenta propostas capazes de serem executadas e garantir a defesa de direitos fundamentais do menor incapaz, mas ainda pode progredir frente à problemática como um todo, gerando espaço para novas medidas e pesquisas mais aprofundadas sobre o tema, ainda não debatido pela população e pouco explorado no ambiente científico.

Abstract:
This study, part of the Project DIREITOS HUMANOS EM CAMPO GRANDE E A INTERSUBJETIVIDADE EM TERMOS DA ÉTICA E DA ALTERIDADE: UM ESTUDO JURÍDICO-FILOSÓFICO E EDUCACIONAL (DHIEA), presents the results of a research that analyzed the problem of child and teenage abandonment under a legal-humanist perspective, through human rights and the Child and Adolescent Statute. In this context, we seek, firstly, to define the concept of abandonment analyzed by this scientific project, and then to understand the position of the Brazilian legal system in view of this problematic contemporary scenario, in which child and youth abandonment deserves even more attention from society and of State. The bibliographical review, the hypothetical-deductive approach method and the unsystematic observation were used as resources, with a focus on a horizontal and interdisciplinary analysis. The results showed that national law behaves in a robust way, through a well-established legal and state apparatus, which presents proposals capable of being implemented and guaranteeing the defense of fundamental rights of the incapable minor, but it can still make progress in the face of the problem as as a whole, creating space for new measures and more in-depth research on the topic, which has not yet been debated by the population and has been less explored in the scientific environment.
