NOÇÕES INTRODUTÓRIAS SOBRE O DIREITO ANIMAL
O presente artigo tem por objetivo apresentar noções introdutórias sobre o Direito Animal enquanto ramo autônomo do Direito, dissociado do Direito Ambiental. Como ponto de partida, analisar-se-á a concepção e preocupação com os animais no decorrer da evolução da sociedade, desde a Idade Antiga até a Contemporânea, passando por autores como Aristóteles, Kant e Descartes até se chegar aos filósofos mais recentes que estudam, especificamente, a ética animal. Em seguida, tratar-se-á do Direito Animal enquanto ciência jurídica e ramo próprio do Direito, esclarecendo seus conceitos e sua relevância para o respeito mútuo entre as espécies e a consideração jurídica dos interesses dos animais não humanos a partir de normas próprias que atendam aos seus anseios. Por fim, discutir-se-á a necessidade de modificação do conceito de animal como coisa para o de sujeito de direitos e, consequentemente, as possíveis categorias jurídicas para o enquadramento dos animais no ordenamento jurídico brasileiro.

Abstract:
This article proposes to present some introductory notions about Animal Law as an autonomous Law’s branch, dissociated from Ambiental Law. First of all, it will be analyzed the conception and the preocupation about animals during the society evolution, since the Old Age until the Contemporary, going through authors like Aristóteles, Kant and Descartes until reaching the most recent philosophers who specifically study animal ethics. Then it will be treated the Animal Law as a legal science and proper branch of Law, clarifying them concepts and them relevance to the mutual respect between the species and the legal consideration about nonhuman animal interests as of own rules which meet them desires. Finally it will be discussed the necessity of turn the animal concept as thing to subject of rights and consequently the possible legal categories for framing animals in the Brazilian legal system.
