MIGRAÇÕES PARTIDÁRIAS, FIDELIDADE E JANELA ELEITORAL: IMPACTO DAS DECISÕES JUDICIAIS NOS PARTIDOS POLÍTICOS
O presente trabalho problematiza a
decisão dos tribunais superiores brasileiros a
respeito da regra da fidelidade partidária, ou seja,
da impossibilidade de parlamentares manterem
os mandatos para os quais foram eleitos depois
de realizarem troca de partido político. O
paper é dividido em quatro momentos. A título
de introdução, será feita uma retrospectiva
histórica do instituto da fidelidade partidária na
legislação brasileira e também em julgamentos
anteriores. Na segunda parte, serão ponderados
argumentos sobre as supostas distorções que
ocorrem no sistema partidário brasileiro como
consequência da adoção do sistema de lista
aberta e seu reflexo na autonomia dos políticos
frente aos líderes e aos partidos políticos.
A seguir, serão consideradas as alterações
normativas promovidas pelos parlamentares
para minimizar os efeitos da decisão judicial.
Finalmente, será avaliado o impacto da decisão
judicial sobre a fidelidade partidária quanto ao
fortalecimento efetivo dos partidos políticos e a
necessidade de sua aplicação para a correção
de uma suposta distorção do sistema partidário.

Abstract:
The present work problematizes
the decision of the Brazilian superior courts
regarding the rule of partisan loyalty, that is, the
impossibility for parliamentarians to maintain the
mandates for which they were elected after the
exchange of political parties. The paper is divided
into four moments. As an introduction, it will be
made a historical retrospective of the institute
of party loyalty in Brazilian legislation and also
in previous judgments. In the second part, it
will be considered arguments about the alleged
distortions that occur in the Brazilian party system
as a consequence of the adoption of the open
list system and its reflection on the autonomy of
politicians vis-à-vis leaders and political parties.
Next, it will be considered thenormative changes
promoted by parliamentarians in 2015 in order
to minimize the effects of the judicial decision.
Finally, it will be evaluated the impact of the
judicial decision on party loyalty regarding the
effective strengthening of political parties and
the need for its application to the correction of a
supposed distortion of the party system.
