MEDIDAS PROTETIVAS EM PROPRIEDADE INTELECTUAL DOS VINHOS PRODUZIDOS NA REGIÃO DEMARCADA DO DOURO/PORTUGAL
A Região Demarcada do Douro-RDD/Portugal, foi a primeira a ser reconhecida como local de um produto com notoriedade, o vinho do Porto. Marquês do Pombal, idealizador, criou a Companhia Geral da Agricultura das Vinhas do Alto Douro, surgindo assim um conceito jurídico de região demarcada e de proteção da propriedade intelectual ou industrial. A região continua a ser referência em proteção, que através de mecanismos legais busca proteger a marca comunitária, Douro/Porto, num contexto internacional. A contrafação em vinhos, por ser um produto rentável e lucrativo, passou a ser um “bom negócio”. O presente estudo tem como objetivos identificar as principais contrafações que afetam a produção e a comercialização de vinhos da DOP Douro/Porto e quais as medidas protetivas em propriedade intelectual são utilizadas para inibir a prática. A metodologia utilizada foi a prospecção de registros de marcas, design e de indicações geográficas nos bancos de dados do INPI (PT), WIPO e TMVIEW, DesignVIEW. E a pesquisa documental, nos arquivos do IVDP, sobre os tipos de contrafações autuados na produção de vinhos. Os resultados obtidos demonstram que apesar de existir um órgão instituído como o IVDP, e constante vigilância, as contrafações são comuns no cotidiano da Indicação Geográfica Douro/Porto, e identificadas em várias partes do mundo. Salienta-se também que nem todas as medidas protetivas são utilizadas.

Abstract:
The Douro Region-RDD/Portugal, was the first one to be recognized as a location of a notorious product, the Port wine. Marquês do Pombal, the founder, created the General Company of Agriculture of the Upper Douro Vineyards, thus resulting in a legal concept of demarcated region and protection of intellectual or industrial property. The region continues to be a reference in protection, which through legal mechanisms seeks to protect the Community trademark Douro / Porto in an international context. Counterfeiting in wine, for being a cost-effective and profitable product, has become a "good deal". This study aims to identify the main counterfeits affecting the production and marketing of wines from the DouroDOP / Port and what protective measures to inhibit the practice are used. The methodology used was the prospection of trademark registrations, design, and geographical indications in the databases of the INPI data (PT), WIPO, and TMview, DesignView. And the documentary research in IVDP files on the types of counterfeits sued in wine production. The data shows that although the existence of an organ established as the IVDP, and constant vigilance, the counterfeits are common in daily Geographical Indication in Douro / Porto, and they are identified in various parts of the world. It is worth noting that not all protective measures are used.
