MARCOS LEGAIS PARA O RETORNO ÀS AULAS COM SEGURANÇA PÓS PANDEMIA DA COVID-19 FRENTE À AFETIVIDADE COMO CONDIÇÃO DE APRENDIZAGEM
Considerando o atual momento vivido pela sociedade mundial que foi atingida pela pandemia da Covid-19, além das mudanças de padrões e estilos de vida, este artigo tem como objetivo apontar os normativos jurídicos, identificando a necessidade dessa segurança jurídica, demonstrando a possibilidade de ação do poder público, analisando a aplicação dos marcos legais, onde o caminho a ser perseguido foi de encontrar nas fontes consultadas a condição jurídica do retorno às aulas presenciais, pesquisando normas, tais como, notas técnicas, portarias, pareceres e leis. Buscou-se ainda analisar a aplicação e viabilidade dessas normas e por fim refletir sobre a possibilidade do retorno às aulas presenciais. A metodologia utilizada foi à pesquisa social com análise qualitativa, usando de meios eletrônicos e físicos para acesso aos documentos. Como hipótese tem a necessidade de legislar sobre a volta às aulas com segurança, onde na conclusão tem-se justamente a falta de legislação para um retorno às aulas com segurança.

Abstract:
Considering the current moment experienced by world society that was hit by the Covid-19 pandemic, in addition to changes in standards and lifestyles, this article aims to point out the legal regulations, identifying the need for this legal certainty, demonstrating the possibility of action government, analyzing the application of legal frameworks, where the path to be pursued was to find in the consulted sources the legal condition of returning to classroom classes, researching standards such as technical notes, ordinances, opinions and laws. It was also sought to analyze the application and feasibility of these standards and, finally, reflect on the possibility of returning to face-to-face classes. The methodology used was social research with qualitative analysis, using electronic and physical means to access documents. As a hypothesis, there is the need to legislate about a safe return to school, where the conclusion is precisely the lack of legislation for a safe return to school.
