CONSIDERAÇÕES CRÍTICAS À TEORIA DA ARGUMENTAÇÃO JURÍDICA DE HABERMAS E ALEXY
O desenvolvimento da racionalidade jurídica pode ser analisado sob diversos enfoques, entre eles a da Teoria da Argumentação Jurídica, que surge na segunda metade do século XX com o objetivo de propor mecanismos de controle sobre a racionalidade do discurso jurídico, possibilitando que as decisões jurídicas sejam pautadas por critérios seguros frente à complexidade dos casos concretos. O objetivo deste trabalho é abordar de forma sucinta a Teoria da Ação Comunicativa de Habermas e a Teoria da Argumentação Jurídica de Alexy, fazendo considerações a suas viabilidades enquanto teorias e efetividades no mundo da vida. A crítica construtiva à racionalidade jurídica contribui para o avanço do próprio Direito, na busca por novas formas lógicas, racionais e éticas de resolução dos conflitos sociais.

Abstract:
The development of the legal rationality might be analyzed under several approaches, among them the Theory of Legal Argumentation, which appears in the second half of 20th century with the objective of proposing control mechanisms on the rationality of the legal speech, making possible that the legal decisions are ruled by safe criteria facing the complexity of the concrete cases. The objective of this work is to approach on a summarized form the Theory of the Communicative Action by Habermas and the Theory of Legal Argumentation by Alexy, making considerations about its viability while theory and effectiveness in the world’s life. The constructive critic to the legal rationality contributes to the advance of the proper Law, in the search for new logical, rational and ethical forms of resolution of their social conflicts.
