LICENCIAMENTO AMBIENTAL MUNICIPALIZADO EM MUNICÍPIO DO NORDESTE RIOGRANDENSE
A preocupação ambiental frente ao crescimento econômico nos traz a
necessidade da criação de mecanismos de controle. Dentre as ferramentas
utilizadas encontramos duas que são usadas para controlar as atividades humanas
frente à preservação do meio ambiente: a) o licenciamento ambiental, que é um
procedimento administrativo utilizado para a liberação e controle de
empreendimento que utilize ou impacte algum tipo de recurso natural e; b) a lei de
crimes ambientais, a qual vem determinar as sanções penais e administrativas
derivadas de condutas e atividades lesivas ao meio ambiente. Com isso, o objetivo
deste trabalho busca realizar uma análise sobre os benefícios gerados para a
população do município de Maximiliano de Almeida através do processo de
municipalização das atividades de licenciamento ambiental e do histórico de
autuações. Se a municipalização das atividades de licenciamento proporcionou
benefícios à população. O trabalho foi realizado de abril a junho de 2015 por meio
de pesquisa primária, com levantamento do histórico de autuações do
Departamento de Meio Ambiental e através de pesquisa secundária em livros, teses,
dissertações e artigos com intuito de coletar maiores informações sobre o assunto
proposto. As informações coletadas foram analisadas e organizadas em figuras e
tabelas para melhor entendimento. Como resultado observou-se que a
municipalização das licenças ambientais agilizou o processo de emissão das
licenças ambientais, porém notou-se o desconhecimento da população
maximilianense sobre a obrigatoriedade do processo. Notou-se ainda que esta
municipalização não trouxe redução no número de autuações.

Abstract:
The environmental concerns against the economic growth brings the
need to create control mechanisms. Among the tools used we find two that are used
to control human activities across the preservation of the environment: a) the
environmental licensing, which is an administrative procedure for the release and
enterprise control using impact or some kind of natural resource and; b) the law of
environmental crimes, which comes determine the criminal and administrative
sanctions derived from conduct and activities harmful to the environment. Thus, the
aim of this paper tries to make an analysis of the benefits generated for the
population of the municipality of Maximiliano de Almeida through the
municipalization process of environmental licensing activities and assessments
history. If the decentralization of licensing activities provided benefits to the
population. The study was conducted from April to June 2015 through primary
research, a survey of assessments history of the Department of Environmental
Medium and through secondary research in books, theses, dissertations and articles
in order to collect more information on the proposed issue . The collected information
was analyzed and organized into figures and tables to better understanding. As a
result it was observed that the municipalization of environmental permits speeded
up the process of issuing environmental permits, but there has been the lack of
maximilianense public about the requirement of the process. It was noted also that
municipalization did not bring reduction in the number of assessments.
