LEGITIMAÇÃO DE POSSE SOBRE TERRAS DEVOLUTAS
O trabalho busca entender o modo de legitimação de posse sobre terras devolutas no território nacional, através de pesquisa da história fundiária no Brasil, do ordenamento legal relevante, da definição de posse e propriedade e das formas de legitimação de posse. A pesquisa buscou compreender também, a aplicação da Constituição do Império até o ordenamento que abarca o Direito Agrário. A partir da conclusão, nota-se que a legislação e a Constituição Federal apresentam a legitimação e a maneira de execução, bem como os instrumentos para se realizar a legitimação de posse. Assim, observa-se que para obter a devida legitimação é necessário executar corretamente os mecanismos disponíveis pela legislação brasileira.

Abstract:
The work seeks to understand the mode of legitimation of possession over vacant land in the national territory, through research on the land history in Brazil, the relevant legal system, the definition of possession and ownership and the forms of legitimation of possession. The research also sought to understand the application of the Constitution of the Empire to the order that encompasses Agrarian Law. From the conclusion, it is noted that the legislation and the Federal Constitution present the legitimation and the way of execution, as well as the instruments to carry out the legitimation of possession. Thus, it is observed that in order to obtain the proper legitimacy, it is necessary to correctly execute the mechanisms available by Brazilian legislation.
