LEGISLAÇÃO INFRACONSTITUCIONAL ESTRANGEIRA: APRESENTAÇÃO DA LEI PROTETIVA DOS ANIMAIS DE LUXEMBURGO
Objetiva-se neste estudo apresentar a Legislação Infraconstitucional Protetiva dos Animais do Estado-nação europeu de Luxemburgo. Trata-se de um estudo qualitativo, básico, descritivo, documental e bibliográfico em que se realizou a leitura e tradução do texto original em francês da Lei nº 537 sobre a proteção dos animais de 27 de junho de 2018 de Luxemburgo e das literaturas disponíveis atinentes à temática Legislação Infraconstitucional Estrangeira Protetiva dos Animais, bem como organização das informações coletadas e análise e discussão das mesmas. No que diz respeito à corrente epistemológica adotada a opção apoia-se no construtivismo. E, atinente à perspectiva teórica priorizada, a escolha assenta-se na investigação crítica. Os resultados deste estudo apontaram que: (i) trata-se de uma Lei que visa garantir a dignidade, a proteção da vida, a segurança e o bem-estar dos animais; (ii) inaugura um novo marco legal para todos os animais no território do Luxemburgo; (iii) fornece uma ampla gama de disposições; (iv) prevê um Sistema mais detalhado, persuasivo e eficaz de controles e sanções em caso de maus-tratos aos animais; (v) define o animal como ser vivo não humano dotado de sensibilidade; (vi) acrescenta a noção de dignidade e segurança do animal; (vii) fornece uma Relação Nominal Nacional de Animais cuja manutenção é permitida; e por fim, (viii) estabelece Autorizações, Aprovações e Notificações. Conclui-se que, não obstante o estudo apresentado estar sedimentado na análise documental da Legislação Infraconstitucional Estrangeira Protetiva dos Animais do Estado-nação de Luxemburgo – a qual representou o foco desta reflexão e constituiu referência prioritária – é importante considerar que acontecimentos nacionais tem forte potencial para se repercutir em dimensões internacionais tornando-se potenciais exemplos para outros Estados-nações.

Abstract:
The objective of this study is to present the Infraconstitutional Legislation Protecting Animals of the European nation-state of Luxembourg. This is a qualitative, basic, descriptive, documentary and bibliographical study in which the reading and translation of the original French text of Law nº 537 on the protection of animals from June 27, 2018 in Luxembourg and the available literature related to the theme of Foreign Infraconstitutional Legislation Protecting Animals, as well as the organization of the collected information and analysis and discussion of the same. The epistemological current adopted was that of Constructivism. The prioritized theoretical perspective was that of critical investigation. The results of this study indicated that: (i) it is a law that aims to guarantee the dignity, protection of life, safety and well-being of animals; (ii) inaugurates a new legal framework for all animals in the territory of Luxembourg; (iii) provides a wide range of provisions; (iv) provides for a more detailed, persuasive and effective system of controls and sanctions in case of mistreatment of animals; (v) defines the animal as a non-human living being endowed with sensitivity; (vi) adds the notion of animal dignity and safety; (vii) provides a National Nominal List of Animals allowed to be kept; and finally, (viii) establishes Authorizations, Approvals and Notifications. It is concluded that, despite the fact that the presented study is based on the documentary analysis of the Foreign Infraconstitutional Legislation Protecting Animals of the Luxembourg nation-state – which represented the focus of this reflection and constituted a priority reference – it is important to consider that national events have a strong potential to have repercussions on international dimensions, becoming potential examples for other nation-states.
