LEGISLAÇÃO INFRACONSTITUCIONAL ESTRANGEIRA: APONTAMENTOS SOBRE A LEI PROTETIVA DOS ANIMAIS DA BOLÍVIA
Objetiva-se neste estudo apresentar a Legislação Infraconstitucional Protetiva dos Animais da Bolívia. Trata-se de um estudo qualitativo, básico, descritivo, documental e bibliográfico em que se realizou a leitura e tradução do texto original em espanhol da Lei nº 071 sobre a proteção dos animais de 21 de dezembro de 2010 da Bolívia – intitulada Derechos de la Madre Tierra – e das literaturas disponíveis atinentes à temática Legislação Infraconstitucional Estrangeira Protetiva dos Animais, bem como organização das informações coletadas e análise e discussão das mesmas. No que diz respeito à corrente epistemológica adotada a opção apoia-se no construtivismo. E, atinente à perspectiva teórica priorizada, a escolha assenta-se na investigação crítica. Os resultados deste estudo apontaram que: (i) trata-se de uma Lei que visa reconhecer os direitos da Mãe-Terra e por consequência os direitos dos animais não humanos considerados como parte integrante da Mãe-Terra; (ii) instaura uma inovadora demarcação legal para todos os animais não humanos no território boliviano; (iii) institui diversos princípios de cumprimento obrigatório em defesa dos direitos da Mãe-Terra e consequentemente em defesa também dos direitos dos animais não humanos; e por fim (iv) regulamenta uma gama de obrigações ao Estado, bem como de deveres à sociedade civil boliviana com o objetivo proteger os direitos da Mãe-Terra, ou seja, os direitos de todos os elementos e/ou indivíduos, de toda e qualquer espécie que integram a natureza. Conclui-se que, embora o estudo exposto esteja alicerçado na análise documental da Legislação Infraconstitucional Estrangeira Protetiva dos Animais da Bolívia – a qual constituiu o cerne desta reflexão e consistiu referência preferencial – é relevante ter em consideração que eventos nacionais têm forte potencial para se ecoar em contextos internacionais tornando-se possíveis exemplos para outros Estados-nações.

Abstract:
The objective of this study is to present the Infraconstitutional Legislation for the Protection of Animals of Bolivia. The objective of this study is to present the Infraconstitutional Legislation for the Protection of Animals of Bolivia. This is a qualitative, basic, descriptive, documentary and bibliographic study in which the original text in Spanish of Law No. 071 on the protection of animals of December 21, 2010 of Bolivia – entitled Derechos de la Madre Tierra – and the available literatures related to the theme Foreign Infraconstitutional Legislation for the Protection of Animals, as well as organization of the information collected and analysis and discussion thereof. With regard to the epistemological current adopted, the option is based on constructivism. And, regarding the prioritized theoretical perspective, the choice is based on critical investigation. The results of this study pointed out that: (i) it is a Law that aims to recognize the rights of Mother Earth and consequently the rights of non-human animals considered as an integral part of Mother Earth; (ii) establishes an innovative legal demarcation for all non-human animals in Bolivian territory; The results of this study pointed out that: (i) it is a Law that aims to recognize the rights of Mother Earth and consequently the rights of non-human animals considered as an integral part of Mother Earth; (ii) establishes an innovative legal demarcation for all non-human animals in Bolivian territory; (iii) establishes several principles of mandatory compliance in defense of the rights of Mother Earth and consequently also in defense of the rights of nonhuman animals; and finally (iv) regulates a range of obligations to the State, as well as duties to Bolivian civil society with the aim of protecting the rights of Mother Earth, that is, the rights of all elements and/or individuals, of any and all species that integrate nature. It is concluded that, although the present study is based on the documentary analysis of the Foreign Infraconstitutional Legislation for the Protection of Animals of Bolivia – which constituted the core of this reflection and consisted of a preferential reference – it is relevant to take into account that national events have strong potential to be echoed in international contexts, making them possible examples for other nation-states.
