LA VIOLENCIA DE GÉNERO Y LA RESPONSABILIDAD PENAL DE LA PERSONA PROCESADA EN EL ECUADOR
Las agresiones físicas, verbales y psicológicas se conocen como violencia de género, se integraron al Código Orgánico Integral Penal en el 2014 y sus resultados influyen de manera drástica en la sociedad. El propósito de este estudio fue determinar cuál es la responsabilidad penal del sujeto procesal en los tipos de violencia de género en el Ecuador. La muestra del estudio, para determinar cuál ha sido la incidencia y afectación penal sobre la persona procesada, estuvo conformada por los casos de abuso sexual contra la mujer en el 2014. Estos datos fueron expuestos por el Instituto Nacional de Estadística y Censo. Se determinaron siguientes las variables: número de casos que han sido denunciados y los que han sido sancionados. Los hallazgos revelan que la creación de instancias como comisarías de la mujer y familia generaron un mayor número de denuncias. Aunque el número de denuncias ha aumentado, este no revela un porcentaje real de la situación actual debido a la falta de conocimiento de la sociedad sobre este delito, sus causas y su sanción. Se sigue reflejando un alto índice de impunidad por las múltiples trabas sociales y la presión social.

Abstract:
The physical, verbal and psychological aggressions are known as a violence of gender, they were added to “Código Orgánico Integral Penal” in 2014 their results got a drastic influence in society. The purpose of this study was to determine which the penal responsibility of the trial is when it comes to the violence of gender in Ecuador. The outcome of the study, to determine what has been the incidence and penal charge of the accused subject, it consisted in cases of sexual abuse against women in 2014. These data were exposed by the “Instituto Nacional de Estadística y Censo”. The following variables were determined: The number of cases that have been reported and the ones that were charged against. The findings reveal that the creations of institutions like women’s and family’s stations generated a bigger number of charges. Although the number of denunciations has increased, it hasn’t revealed the real percentage of the actual situation since there is a lack of knowledge in society about this type of crime, its causes and its charges. It is still reflecting a high impunity for the multiples social pressure and obstacles.
