JUSTIÇA, VINGANÇA PRIVADA E O IMAGINÁRIO POPULAR PUNITIVISTA
Almejou-se com este artigo analisar a presença da vingança na concepção popular de justiça ao longo do tempo e as punições desproporcionais ocasionadas por esse imaginário. Como evoluiu historicamente o imaginário punitivista a partir da concepção popular do que seja a justiça? De que forma a ideia de Justiça e de punibilidade foi abordada pelos pensadores do Direito? Quais as reverberações desse imaginário vingativo no momento contemporâneo? Realizou-se leituras e análises de fontes bibliográficas e estudos de casos contemporâneos que evidenciam a relação entre vingança e justiça. Tem-se como principal conclusão que a natureza humana, com seu pensamento coletivo respaldado no senso comum e levando em consideração suas emoções apenas e não uma moral criada com testes ao passar de gerações, ainda tende a elevar a vingança ao patamar de justiça, efeito que não é originado propositalmente, mas sim derivado da junção de ausência do Estado no cumprimento do seu dever em aplicar e executar leis e um desalinhamento moral das leis escritas, e da política pública criminal, àquelas que atenderiam ao apelo ético e moral do povo.

Abstract:
This article aimed to analyze the presence of revenge in the popular conception of justice over time and the disproportionate punishments caused by this imagination. How did the punitive imaginary evolve from the popular conception of what justice is? How was the idea of justice and punishment addressed by legal thinkers? What are the reverberations of this vengeful imagination in the contemporary moment? Readings and analyzes of bibliographic sources and contemporary case studies were carried out that show the relationship between revenge and justice. Its main conclusion is that human nature, with its collective thinking supported by common sense and taking into account only its emotions and not a morality created with tests over generations, still tends to raise revenge to the level of justice, an effect which is not purposefully originated but rather derived from the combination of the State's failure to fulfill its duty to apply and execute laws and a moral misalignment of written laws, and criminal public policy, with those that would meet the ethical and moral appeal of the people.
