JUSTIÇA RESTAURATIVA COMO MEIO DE EMPODERAMENTO DE MULHERES EM SITUAÇÃO DE VIOLÊNCIA DOMÉSTICA
Com o progressivo aumento de crimes praticados contra mulheres no âmbito das relações domésticas, fato que está diretamente ligado à questão de gênero e apresenta-se altamente complexo, uma vez que exige diversas medidas para a sua contenção, não só no âmbito penal para a resolução do conflito, objetiva-se, com o presente trabalho, demonstrar a importância da Justiça Restaurativa. Esse instituto auxilia no empoderamento de mulheres vítimas de violência doméstica, também será exposta a importância da criação de grupos de reflexão de agressores, sem que isso implique na desresponsabilização pelos atos praticados sob o viés tradicional. A pesquisa, que será qualitativa e exploratória, utilizará o método indutivo, sendo o procedimento monográfico, por meio de pesquisa bibliográfica e documental. Desse modo, o estudo realizado atenta para a formação da sociedade, ainda permeada de resquícios patriarcais, que busca enfrentar a violência de gênero através da aplicação de penas privativas de liberdade, as quais notadamente tem gerado um ciclo de reprodução e retribuição de violência contra as vítimas de violência doméstica e seus agressores. Destarte, o modelo retributivo não atinge os fins propostos pela pena, como a ressocialização do condenado e também pelo fato de colocar a vítima em segundo plano. Já a Justiça Restaurativa permite enxergar o crime com outro olhar, bem como passa a centralizar o foco de atuação nas vítimas, restaurando, por meio do diálogo, os danos causados em razão do conflito social subjacente à prática delitiva, possibilitando que elas assumam posição de protagonistas.

Abstract:
With the progressive increase in crimes committed against women in domestic relationship, which is directly connected in gender questions and presents a very complex situation, what requires several measures to contain it, not just a penalty resolution for the conflict. Therefore, the objective of this project is demonstrate the importance of Restorative Justice. That institute helps to empower women's victims of domestic violence, also will be exposed the importance in the formation of reflection groups for offenders, without involves the unaccountability by acts practiced through the traditional slant. The research, which will be qualitative and exploratory, will use inductive method, procedure monograph, by means of bibliographic and documental research. Therefore, the study accomplished stresses for the social formation, still permeated by patriarchal remnant, that seek to combat the gender based violence through the application of custodial sentences, those wich clearly has caused a cycle of reproduction and retribution of violence against women's victims of domestic violence. Thus, the retributive model does not reach the purposes of the sentence, for example, the resocialization of the condemned, also putting the victim in secondary plan. The Restorative Justice allow to see the crime with another look, as well as start to centralize the focus of action on the victims, restoring, through dialogue, the damage caused by virtue of social conflict derive from criminal action, enabling they to become protagonist.
