Justiça e poder dos argumentos
Este capítulo apresenta uma possível resposta à pergunta: Como o poder dos argumentos se transforma em decisões justas? Para isso, levanta-se a relação entre a justiça e o poder dos argumentos, e como o juiz é convencido por este último da veracidade de alguns fatos. Para isso, mostra-se como o Juiz para a construção de seu conhecimento factual deve partir dos elementos probatórios que contribuem para o respectivo processo. Foucault, apresenta esse exercício probatório como a indagação necessária na construção da verdade. A referida investigação levará o juiz a descobrir a verdade e a partir daí estruturar a decisão judicial com a qual se pretende convencer o público de que é justa e adequada ao conhecimento construído no processo. O poder consistirá na possibilidade de impor uma sanção contra um determinado comportamento. Mas, a construção dessa verdade depende da força ou poder do argumento (discurso) e do grau de convicção que é gerado na audiência. A verdade é uma construção que resulta do peso do argumento, e quando essa verdade é encontrada, abre-se o caminho para a justiça, o que está acima é o resultado que se pretende mostrar ao longo deste capítulo.

Abstract:
This chapter presents a possible answer to the question: How does the power of arguments become fair decisions? For this, the relationship between justice and the power of arguments is raised, and how the judge is convinced through the latter of the veracity of some concrete facts. For this, it is shown how the Judge for the construction of the factual knowledge of him must start from the evidentiary elements that are contributed to the respective process. Foucault, presents this probative exercise as the necessary inquiry in the construction of the truth. Said investigation will lead the judge to discover the truth and from there structure the judicial decision with which it is intended to convince the audience that it is fair and adequate to the knowledge built through the process. The power will consist of the possibility of imposing a sanction against a given behavior. But, the construction of that truth depends on the force or power of the argument (speech) and the degree of conviction that is generated in the audience. The truth is a construction that results from the weight of the argument, and when that truth is found, it opens the way to justice, the above is the result that is intended to be shown throughout this chapter.
