JUDICIALIZAÇÃO NA SAÚDE: EFETIVIDADE PRESTACIONAL DOS SERVIÇOS DE SAÚDE
RESUMO: O direito à saúde é um dos direitos fundamentais e, portanto, está previsto o dever de prestação a ser garantido pelo Estado para que a dignidade da pessoa humana não seja violada. Diante disso, a judicialização da saúde revela-se como uma possibilidade de acesso de medicamentos e procedimentos de saúde de forma célere. Para tanto, foi utilizada a metodologia de pesquisa descritiva e qualitativa para que haja a possibilidade de uma maior capacidade teórico-metodológica. Justifica-se a escolha do tema, por se tratar de uma problemática atual, e devido às proporções que esta questão afeta à população. A discussão do trabalho também está inserida na questão de filas de espera do SUS, de modo que é constantemente mencionado sobre essas filas de espera em se tratando de prestação de serviços públicos. O trabalho foi realizado havendo um estudo formal sobre a matéria, e por fim um estudo sobre os procedimentos seguidos pelas agências reguladoras na habilitação do paciente para recebimento da cirurgia cardíaca, sem, contudo, esgotar o estudo acerca da temática da judicialização da saúde.

Abstract:
ABSTRACT: The right to health is one of the fundamental rights and, therefore, the duty to provide it is foreseen to be guaranteed by the State so that the dignity of the human person is not violated. In view of this, the judicialization of health reveals itself as a possibility of accessing medicines and health procedures quickly. For this purpose, a descriptive and qualitative research methodology was used so that there is the possibility of a greater theoretical-methodological capacity. The choice of theme is justified, because it is a current problem, and due to the proportions that this issue affects the population. The discussion of the work is also inserted in the question of SUS waiting lines, so that it is constantly mentioned about these waiting lines when it comes to the provision of public services. The work was carried out with a formal study on the matter, and finally a study on the procedures followed by regulatory agencies in enabling the patient to receive cardiac surgery, without, however, exhausting the study on the theme of the judicialization of health.
