Abstract: The paper analyzes the phenomenon of health judicialization in the Municipality of Araquari-SC in light of the context of Brazilian federalism and the regulations governing the Unified Health System (SUS). The 1988 Constitution established health as a fundamental right, discussing the role of the Judiciary as a mediator in the realization of this right, considering the implications of judicialization for the federative entities and the challenges faced by municipalities in providing health services. The analysis includes data on the population growth of Araquari, the increase in judicial demands, and the budgetary challenges faced by local public management due to the rising judicialization, as well as examples of frequently litigated cases.
