JUDICIALIZAÇÃO DA SAÚDE COMO INSTRUMENTO PARA EFETIVAR A GARANTIA CONSTITUCIONAL À SAÚDE
O presente estudo demonstra a necessidade de intervenção do Poder Judiciário em face do Poder executivo para a efetivação do direito fundamental à saúde, demonstrando para tanto as disposições constitucionais contidas no artigo 6º e 5º da República Federativa do Brasil. Aborda também, que pela intervenção jurisdicional é protegido o direito à vida, pois através da garantia constitucional à saúde, é que podemos garantir a vida. A judicialização em face do Poder Executivo só ocorre, por que este, por sua vez não se utiliza de políticas públicas capazes de alcançar toda sociedade, e por este motivo, o Poder Judiciário é acionado para intervir na garantia que é resguardada constitucionalmente de forma ampla.

Abstract:
The present study demonstrates the need for the Judiciary to intervene in the face of the Executive Power for the realization of the fundamental right to health, demonstrating for that purpose the constitutional provisions contained in article 6 and 5 of the Federative Republic of Brazil. It also addresses that, through jurisdictional intervention, the right to life is protected, because through constitutional health guarantees, we can guarantee life. Judicialization in the face of the Executive Power only occurs, because it, in turn, does not use public policies capable of reaching the whole society, and for this reason, the Judiciary Power is called upon to intervene in the guarantee that is constitutionally protected in a broad way.
