INTERPRETAÇÃO TÓPICO-SISTEMÁTICA E FEDERALISMO COOPERATIVO NA SEARA DA SAÚDE PÚBLICA NO BRASIL: BREVES DELINEAMENTOS
O regime de repartição de competências administrativas comuns se encontra fundado na ideia de que todos os entes federativos devem atuar na seara de determinadas matérias, entre as quais a saúde pública. Em que pese a decisão do plenário do Supremo Tribunal Federal na medida cautelar da ADI n. 6.341/DF tenha tratado acerca da temática, exsurgiram antinomias jurídicas que podem ser solucionadas a partir da hermenêutica constitucional. A interpretação tópico-sistemática dos conflitos entre quais medidas tomadas pelos entes federativos devem prevalecer nos leva à resposta de que, independentemente da esfera de governo — União, Estados, Distrito Federal, ou Municípios — que tenha adotado determinada medida, desde que dentro do regime constitucional de repartição de competências (artigo 23 da CRFB), a medida que deverá prevalecer será aquela que se mostrar mais restritiva de direitos no tocante à capacidade de, em maior grau, proteger e promover a saúde pública. Ademais, frente ao atual cenário pandêmico, é imprescindível — como sempre o é — socorrermo-nos de uma nova interpretação constitucional, alicerçada na proposta de que a Administração Pública deve respaldar as medidas por ela adotadas no combate à Covid-19 também nos princípios constitucionais da prevenção e da precaução, de modo a agir de forma célere quanto às necessidades da sociedade, sob pena de irreversibilidade dos efeitos de medidas menos restritivas no enfrentamento à atual crise sanitária. A hermenêutica constitucional, por meio da interpretação tópico-sistemática, é capaz de conferir uma maior cooperação entre os entes federativos no enfrentamento ao coronavírus, rumo a um federalismo cooperativo mais efetivo na seara da saúde pública.

Abstract:
The regime for the sharing of common administrative powers is based on the idea that all federal entities must act in the field of certain matters, including public health. Despite the decision of the Supreme Federal Court in the precautionary measure of ADI n. 6.341/DF has dealt with the theme, there arose legal antinomies that can be solved based on constitutional hermeneutics. The topic-systematic interpretation of the conflicts between which measures taken by the federal entities must prevail leads us to the answer that, regardless of the sphere of government — Union, States, Federal District, or Municipalities — that has adopted a certain measure, provided that within the regime constitutional division of powers (article 23 of the CRFB), the measure that should prevail should be the one that is more restrictive of rights with respect to the ability to protect and promote public health. Furthermore, in the face of the current pandemic scenario, it is essential to resort to a new constitutional interpretation, based on the proposal that the Public Administration must support the measures adopted by it in the fight against Covid-19 also in the constitutional principles prevention and precaution, in order to act quickly in relation to the needs of society, under penalty of irreversibility of the effects of less restrictive measures to face the current health crisis. Constitutional hermeneutics is capable of conferring greater cooperation between federative entities in the fight against the coronavirus through topic-systematic interpretation, towards a more effective cooperative federalism in the field of public health.
