Este artigo aponta o crescimento da disseminação das tecnologias associadas à Inteligência Artificial (IA) tanto em atividades de pesquisa, desenvolvimento e inovação, como também na vida cotidiana da sociedade, identificando um cenário-hipótese de um futuro próximo em que a IA passará a divulgar soluções a diversas situações (cotidianas ou de novas tecnologias) de forma massiva, automatizada e acelerada que poderá impactar na novidade de futuras invenções que poderiam ser patenteadas. A questão que se coloca é se essa divulgação massiva de conteúdo pode ser considerada como estado da técnica durante o exame de patentes. Nesse sentido, serão analisadas as disposições legais e normativas brasileiras que se aplicam ao requisito de novidade e estado da técnica, com o intuito de discutir se o atual arcabouço normativo brasileiro relacionado ao requisito de novidade de patentes mereceria adaptações.

  • Abstract: This article points out the growth of the dissemination of Artificial Intelligence (AI) associated technologies in research, development, innovation activities, as well as in everyday life, and it raises a hypothesis of a near future scenario where AI will disclose solutions to various situations (everyday or technological) in a massive, automated and accelerated way, in such a way that would impact the novelty of future inventions that could be patented. The main question that arises is whether this massive dissemination of contents can be considered prior art affecting the patent examination. In this sense, the Brazilian legal and regulatory provisions applicable to the requirements of novelty and prior art will be analyzed, aiming to discuss whether the current Brazilian normative framework related to the novelty requirement of patents should be adapted.
